Justices Hear Arguments on Strip Search of a Minor in School

I've commented on this case before in this blog, and mentioned it as an example in class. Yesterday the Supreme Court heard oral arguments in the case. Here is a discussion of what went on there from the NewsHour on PBS:

I think that this strip search was unconstitutional. They would have to have reasonable cause to believe that the drug was on her body to do a strip search. But her locker wasn't even searched so there would be no reason to think it was.

while i can see the school officials point, because their just protecting other students, but i see the search as totally unconstitutional. This violates the 4th amendment (no unreasonable searches or seizures with warrant or probablable cause) however on the other hand their was probable cause, because the school officials suspected he was carrying contraban (in this case, prescription strength aspirnin) and went ahead and searched him/her which would technically be constitution, because they had probable cause. so this one can be easy argued either way. you can either argue that it's constitional since they had probable cause, or you can argue that it's unconstitutinal because it happened to a minor.

This violates the 4th amendment (no unreasonable searches or seizures with warrant or probablable cause. I do see where the school authorities were coming from when searching a student that supposedly had pills on her but they definetly went to far.

I thought what happened here was unconstitutional. I don't think the school had the right to search this person. This is unconstitutional because it goes against the fourth amendment. They should have approached this problem in a different way. The school officials did suspect that this person had something so I think they searched her to make sure. According to the fourth amendment you can only search with a warrant or probable cause.

i can see how the school really cares about safety of other's but then again... they are taking the girl's right away from her while they force her into a strip search. it might be the right thing to do but they are not respecting her right and they need to find a way to be able to search her but she still has a right.

Current Event #4: I understand that the school was just doing what they thought was necessary, but I don't believe that they had any right to force this girl to strip and search her. they should have done more research and questioned her about it instead of jumping to conclusions, and making her take off her clothes. i think its a violation of privacy.

This not only violates the constitution, no unreasanable searches or seizures, but it is morally wrong. They strip searched a young girl. I think that is disgusting and if i was that girl i would sue the Sh*t out of that school!
